1. Ownership and use
Unless otherwise noted, all content on BroadcastMediaInc.com — including text, graphics, logos, designs, layout and code — is the property of Broadcast Media Inc or its licensors and is protected by United States and international copyright and trademark laws. You may not reproduce, distribute, modify or create derivative works from this content without our prior written permission.
2. Respect for intellectual property
We respect the intellectual-property rights of others and expect users of the Services to do the same. We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act ("DMCA").
3. Filing a notice of infringement
If you believe content on the Site infringes your copyright, please send a written notice to our designated agent that includes:
- A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with enough detail for us to locate it (such as the URL).
- Your contact information, including address, telephone number and email.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on the owner’s behalf.
4. Counter-notification
If you believe your material was removed or disabled by mistake or misidentification, you may submit a counter-notification containing the elements required by the DMCA, including your contact information, identification of the removed material and its prior location, a statement under penalty of perjury that you have a good-faith belief the material was removed in error, and your consent to the jurisdiction of the appropriate federal court.
5. Repeat infringers
In appropriate circumstances, we will disable access for, or terminate the access of, users who are determined to be repeat infringers.
6. Designated agent
Notices and counter-notifications should be sent to our designated agent at connect@broadcastmediainc.com, or by mail to Broadcast Media Inc, 1712 Pioneer Ave., Ste 500, Cheyenne, WY 82001. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or was removed in error, may be liable for damages.
